TERMS OF SALE FOR ONLINE PUBLIC AUCTION
OF JUDICIAL AND NON-JUDICIAL SALE OF REAL ESTATE
GENERAL TERMS: All properties are conveyed by Special Warranty Deed, subject to any easements, covenants, or conditions of record, and any rights of persons in possession, but free and clear of judgment liens and deeds of trust. Properties are offered for sale as-is, where is, without any representations or warranties, either expressed or implied. A property may not have a right-of-way to a public road. Properties are sold in gross and not by the acre. The highest bidder will be responsible for taxes beginning November 1, 2025 going forward.
The information shown, including any maps, is derived from public records that are constantly undergoing change and do not replace a site survey or inspection. There is no warranty as to the accuracy of the visual maps, nor is the information contained therein a legal representation of any of the features of the property which it depicts. Persons are encouraged to make a visual inspection of the property within the limits of the law and to obtain an independent title search prior to bidding on any of the properties. Bidders are strongly encouraged to make their own inspection to determine the suitableness of the property and it is assumed that all bidders will perform due diligence prior to the day of the auction. Any costs incurred by the bidder to inspect the property are at the expense of the bidder and are non-refundable.
All interested parties must register and be approved by Virginia Auction Company. Registration and bidding are free of charge and are done through the auction company’s website at vaauctionco.com. If any interested bidder wishes to bid on a property, but does not have access to the internet, please contact the auction company at 757-538-0123 for assistance.
The sale of property to the highest bidder is not contingent upon obtaining financing. Financing, if needed, is the sole responsibility of the high bidder. By bidding, parties are entering into a legally binding contract, waive all rescission rights, and understand that their bid is immediately binding, irrevocable, and enforceable. Additionally, by bidding, parties are representing that they have read, and agree to be bound by, all terms and conditions for this sale. If the purchaser fails to complete the transaction for ANY reason, their deposit will be forfeited and they may be held responsible for any deficiency in price upon resale, and the costs of resale, among any other remedies allowed by law. In addition, any high bidder who fails to fulfill their contractual obligations will be banned from bidding at future auctions conducted by Sands Anderson PC.
JUDICIAL TERMS: All sales are subject to confirmation by the Circuit Court of the County of Culpeper. In the event a sale is not confirmed by the Circuit Court, be redeemed by the landowner, or have the sale reheard and found in favor of the landowner, the purchaser's sole remedy shall be return of any amounts paid by the purchaser towards the purchase of the parcel(s). The purchaser understands that the former owner of the parcel(s) may for good cause shown, within ninety (90) days from the entry of the sale confirmation, petition the Court to have this sale reheard.
There will be a 10% buyer’s premium added to the final bid to determine the “total sales price”. Please consider the buyer’s premium when placing your bids. The highest bidder will receive their purchase contract and payment instructions via email by the close of the business following the auction. The contract shall immediately be executed and returned to Sands Anderson.
The highest bidder shall deposit 10% of the total sales price with the Special Commissioner, which sum shall be credited toward the purchase price at closing. The deposit must be received within five (5) business days following the auction closing (no later than Tuesday, October 21, 2025 at 5:00 p.m., EST). The balance of the purchase price, shall be deposited with the Special Commissioner within 15 days of Court confirmation. Recording costs for deed recordation will be the responsibility of the successful bidder and will be due with the balance of the purchase price within fifteen (15) days of confirmation of sale by the Court. TIME IS OF THE ESSENCE. All payments must be made in the form of cash, good check, certified funds, cashier’s check, money order or wire transfer. Sands Anderson PC will provide instructions on how to tender your deposit.
NON-JUDICIAL TERMS: All sales are subject to confirmation by the Culpeper County Treasurer. In the event a sale is not confirmed by the Treasurer or be redeemed by the landowner, the purchaser's sole remedy shall be return of any amounts paid by the purchaser towards the purchase of the parcel(s).

You recognize and acknowledge, however, that technical problems with hardware, software, or internet connectivity, as well as human errors, may arise and may affect, without limitation, the sale website, our online bidding program and process, your or our internet service and access, and your connection to this sale bidding program and process. You further acknowledge that these and other technical problems may develop at any time and with or without notice. You acknowledge and agree that we, Virginia Auction Company, Inc. are not in any way responsible for any such technical problems, and that you have no absolute or other right to be able to bid on this sale in the event of any such technical problems. Notwithstanding the foregoing, you further acknowledge and agree that, in the event of any such technical problems we reserve the right to postpone or cancel the sale and/or extend the bidding time for this sale and/or relist the property for sale at another time, in our sole discretion, and that our decision with regard to any such actions is and will be final. Bidders must take care in entering bids, and each bidder will be responsible for all bids placed under the Bidder’s approved registration. Once entered and recorded online, a bid is deemed to be final on behalf of the registered Bidder and may not be modified, retracted, or rescinded in whole or in part.
Virginia Auction Company Terms and Conditions
Bidding: The auction software and our online bidding platform will notify bidders by email if they have been outbid. Please consider using the “Max Bid” feature as this will allow the software to bid on your behalf up to, but not exceeding, your Max Bid. If two or more bidders put in the same Max Bid, the auction software will recognize the earliest placed bid. The real estate is offered for sale to all persons without regard to race, color, religion, sex, handicap, marital/partner status or national origin.
Auction Ending: The Auction is scheduled to end at the published end time, subject to auto-extend bidding. Each time a bid is placed with the clock showing less than 2 minutes, the clock will reset to 2 minutes. If there are no bids within 2 minutes, the auction will end. This procedure prohibits any last second “sniping” from taking place and making it fair for everyone. In the event the auto-extend time needs to be reduced, Virginia Auction Company, Inc. reserves the right to adjust the auto-extend, as needed. Each lot will be scheduled to close 5 minutes apart starting at the scheduled end time.
Inspection: All property is being sold “As is, Where is, With all faults.” With no warranties expressed or implied of any kind. Bidders are encouraged to rely solely on their own due diligence. The Auctioneer, its agents and subagents, assume no liability for errors or omissions in this or any other property listing or advertising or promotional/publicity statements and materials. All information provided was gathered from sources deemed reliable.
Bidding: The Auctioneer reserves the right to accept or reject any and all bids. Bids are accepted online only. Virginia Auction Company, Inc. is not responsible for failed execution of bids due to bidder’s technological difficulties or issues.

Acceptance: By registering to bid for this auction, you are confirming that you do not owe taxes and or other charges to Culpeper County; also should it be determined that you do owe taxes and or other charges to Culpeper County, your auction deposit will be seized by Culpeper County to cover the balance. Then if any funds remain, they will be held for a portion of your deposit for the auction. By bidding on any property in this auction, you agree to these terms and conditions set forth.
